Managing the duty of care to employees driving for work is a legal requirement, and this includes employees driving their own vehicles for work. The Health & Safety at Work Act 1974 states that: “It shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all employees.”

This means that: Both management and employees can be prosecuted for road traffic crashes involving work-related journeys, even when the driver is using their own vehicle.

Driver ID is a simple method of identifying individual drivers, where your assets are utilised by multiple drivers. Each time the vehicle ignition is switched on a buzzer sounds to remind the driver to apply the Driver Key, the system will then collect the data via a Driver Key allowing your business to measure and report their movements on vehicle-by vehicle basis.

The hardware
A driver ID key receiver is installed on the vehicle’s dash (no exposed wiring). Each driver is assigned a unique Driver ID key which they must use to ‘log-in’ to each vehicle before they can begin their journey, forcing use and ensuring you have complete data from your mobile workforce.

It’s so simple, all drivers have to do is complete a DVLA consent form which is produced by us. This consent form conforms with data protection and is valid for three years and enables you to check as often as required. The data from the DVLA is then uploaded into the system for you to see at risk drivers and information is relayed to the Driver ID software.

I focus on?
To avoid the possibility of prosecution, a company should include these private vehicles and their drivers in the overall company vehicle policy and operation, and therefore pro-actively manage these vehicles; the policy should include statements relating to the vehicle, the driver and the journey.
The Vehicle
The employee is responsible for ensuring their own vehicle complies with Road Traffic Law, is in a safe and roadworthy condition and fit for purpose. If used for business purposes, the employee is responsible for keeping up-to-date MOT, valid road tax, insurance cover and business use. Service records and safety checks should also be in line with the vehicle manufacturer.
The Management
The employer requires minimum vehicle standards to be met by employee owned cars used for business, which cover NCAP ratings, emissions levels, required safety features and essential breakdown cover.
The driver
The employee is responsible for holding a current and valid driving licence, with up to-date information on endorsements, and for producing this for regular checks by management.
The journey
The business is responsible for taking steps to assure itself that the vehicle and driver are fit for purpose for each business journey undertaken.
